Terms and conditions
Article 1 - Applicability
- Elegance Hair products are custom-made. All purchases for custom made hair pieces or customized lace pieces are final and cannot be returned. The right of withdrawal does not apply. These terms apply to every offer and agreement.
- These terms are available to the customer.
- If the agreement is made electronically, these terms are valid. The terms and conditions are made available through Elegance hair's webshop before any electronic purchase takes place. It is the customer's responsibility to review the terms and conditions thoroughly.
- If specific product or service terms apply, the customer can choose the terms that are most favorable in case of a conflict.
- Situations not covered by these terms should be assessed according to the spirit of these terms.
- Any ambiguities should be interpreted according to the spirit of these terms.
Article 2 - The Offer
- If an offer has a limited validity period or conditions, it will be stated clearly.
- Offers are non-binding and can be changed or adjusted by Elegance Hair.
- Offers will accurately describe the products or services. If images are used, they will be a true representation. Mistakes do not bind Elegance Hair.
- All images and specifications are indicative and cannot be grounds for compensation or cancellation.
- Product images are accurate, but colors may not match exactly.
- Offers will include clear information about prices, shipping costs, payment, delivery, and how to accept the offer.
Article 3 - The Agreement
- The agreement is made when the customer accepts the offer and meets the conditions.
- If accepted, Elegance Hair will confirm receipt electronically.
- Elegance Hair will use appropriate measures to secure electronic data transfer and ensure a safe web environment. If electronic payment is possible, security measures will be taken.
- Elegance Hair will provide the following information to the customer digitally or in a way that can be saved:
- the business address for complaints;
- information on warranties and after-sales service;
- the data included in Article 4 paragraph 3, unless already provided.
Article 4 - Exclusion of Right of Withdrawal
- The right of withdrawal is excluded for products described in Article 2 paragraphs 1 and 3.
- Exclusion is possible for products and services:
- Custom made wigs;
- Custom made clip-ins;
- Customized lace pieces;
Article 5 - The Price
- Prices will not increase during the validity period stated in the offer.
- Prices may vary for products subject to financial market fluctuations. This will be stated in the offer.
- All prices are subject to printing and typographical errors. Elegance Hair is not obligated to deliver products at an incorrect price.
Article 6 - Conformity and Warranty
- A 2-week warranty applies after the agreement is made.
- Elegance Hair guarantees products and services will meet the agreement, specifications, and legal requirements. If agreed, products are also suitable for special use.
- Defects or incorrect products must be reported within 2 weeks of delivery. Products must be returned in original packaging and new condition.
- The warranty does not apply if:
- The customer has repaired or altered the products themselves or had them done by third parties;
- The products have been exposed to abnormal conditions or handled carelessly;
- The defect is due to government regulations on materials.
Article 7 - Delivery and Execution
- Elegance Hair will carefully handle orders and deliver after payment.
- The delivery address is the one provided by the customer.
- Elegance Hair will execute accepted orders as soon as possible, but no later than 7 business days unless a longer period is agreed. Delays will be communicated.
- Delivery times are indicative and not grounds for compensation. Article 8 - Payment
- Products and services can be paid in cash, by bank transfer, or via payment request. For service agreements, this period starts after confirmation of the agreement.
- The customer must report any inaccuracies in payment data promptly.
Article 9 - Complaints Procedure
- Elegance Hair has a complaints procedure and handles complaints accordingly.
- Complaints about the execution of the agreement must be submitted within 2 weeks after discovery.
- Complaints will be answered within 14 days. If more time is needed, the customer will be informed within 14 days with an indication of when to expect a detailed answer.
- Complaints do not suspend the obligations of Elegance Hair unless otherwise indicated.
- If a complaint is justified, Elegance Hair will repair the products.
Article 10 - Disputes
- Dutch law applies to agreements between Elegance Hair and the customer, even if the customer lives abroad.
Article 11 - Additional or Different Provisions
Additional or different provisions must not disadvantage the customer and must be recorded in writing or in a way that can be saved by the customer.
